Regulations
(1) The Minister may, by notice in the Gazette, make regulations regarding— (a) any matter which is required or permitted by this Act to be prescribed; (b) any matter relating to the fees contemplated in sections 22 and 54; (c) any notice required by this Act; (d) uniform criteria to be applied by the information officer of a public body when deciding which categories of records are to be made available in terms of section 15; and (e) any administrative or procedural matter necessary to give effect to the provisions of this Act.
(2) Any regulation in terms of subsection (1) must, before publication in the Gazette, be submitted to Parliament.
(3) Any regulation in terms of subsection (1) which— (a) relates to fees; or (b) may result in financial expenditure for the State, must be made by the Minister acting in consultation with the Minister of Finance.
(4) Any regulation in terms of subsection (1) may provide that any person who contravenes a provision thereof or fails to comply therewith is guilty of an offence and on conviction liable to a fine or to imprisonment for a period not exceeding two years.
What this means in practice
- This is the source of the 'prescribed' forms, fees and procedures the Act keeps referring to — the Minister makes them by Gazette, subject to Parliament (and Finance for fees).
